TO HOLD A LOCAL INQUIRY to hear representations from persons interested in the land comprised in the below applications and, at his discretion, to hear representations from any other persons who may desire to appear and be heard. Copies of the application forms and accompanying documents referred to therein can be obtained by request from The Planning Inspectorate, Crown Buildings, Cathays Park, Cardiff, CF10 3NQ or wales@pins.gsi.gov.uk. The Common land applications are made under section 16 and 38 of the Commons Act 2006. If permission is granted by the Welsh Ministers, it will authorise the applicant, RWE Innogy UK Limited, to undertake works on and to deregister common land where replacement land will be given in exchange. The proposal for each application is listed below:

 

Section 38 Applications – Proposed works on Common Land

Ref. 516138 (CL68)

 

The application proposes 525m of new access track and the widening of 2390m of existing road along Heol y Barna, including associated retaining structures and gates and cattle grids, to provide a suitable access to facilitate the construction, operation and decommissioning of the Wind Farm. The works are located on Gopa Hill Common (CL68) between a point approximately 100m to the east of the A48 at Bolgoed Road, Pontarddulais and along the existing road at Heol y Barna.

Ref. 516139 (CL74)

The application proposes 120m of temporary fencing enclosing a total area of 900m² to protect Scheduled Ancient Monument GM202 for the duration of the works to the access track. The works are located on Mynydd Pysgodlyn and part Graig-y-Bedw, Pentwynmawr, Banc Myddfai, Garn Fach and Banc Darren Mawr Common (CL74) adjacent to Heol Glyn Dyfai and approximately 2km north of Felindre.

 

Ref. 516140 (CL77)

The application proposes 48m of temporary fencing enclosing a total area of 144m² to protect undesignated historic asset MG62 for the duration of the works to the access track. The works are located on Mynydd y Gwair Common (CL77) approximately 1km north of the Upper Lilw Reservoir.

 

Ref. 516141 (CL77)

The application proposes works to four sections (with a total length of 242m) of the existing ditch system alongside Rhydypandy Road to deter vehicular access on the Common. The works are located on Mynydd y Gwair Common (CL77) along the west side of Rhydypandy Road approximately 4km to the south-east of Ammanford.

 

Section 16 Applications – The deregistration and exchange of Common Land

Ref. 516142 (CL77)

The release land – 123,100m² of land forming part of CL77 Mynydd y Gwair Common. CL77 extends from Craig-cefn–parc (4km west of Pontardawe) at its most southern extent to approximately 2km southeast of Ammanford at its most northern extent.

The replacement land – 125,000m² of land adjoining CL77 and forming part of Blaen yr Olchfa Fach Farm which is located approximately 2km northwest of Craig Cefn parc and is bounded to the north, east and west by CL77 (approx. grid reference 266783 204967).

 

The purpose of this application is to enable the construction of part of the access track and 7 wind turbines to a maximum blade tip height of 127 meters as part of the wind farm area, which also includes 9 wind turbines on the adjacent Mynydd Pysgodlyn and part Graig y Bedw, Pentwynmawr, Banc Myddfai, Garn Fach and Banc Darren Mawr Common (CL74), together with associated external transformers, crane hardstandings, a construction compound and permanent met mast.

 

Ref. 516143 (CL74)

The release land – 257,500m² of land forming part of CL74 Mynydd Pysgodlyn and part Graig y Bedw, Pentwynmawr, Banc Myddfai, Garn Fach and Banc Darren Mawr Common. (CL74) extends from approximately 2.5 km east of Pontarddulais at its most south-westerly extent to approximately3km south of Ammanford at its most northern extent.

 

The replacement land – two parcels of land adjoining CL74 and totalling 174,200m² and situated at Blaen Gerdinen which is located adjacent to an unnamed road approximately 2km southeast of Garnswllt (Approx grid reference 263683 207589; and adjacent to Blaennant Ddu which is located adjacent to an unnamed road to the south of the Afon Dulais to the north, and is approximately 3km southeast of Garnswllt (approx. grid reference 264387 206563).

 

The purpose of this application is to enable the construction of part of the access track and 9 wind turbines to a maximum blade tip height of 127 meters as part of the wind farm area,
